Jan 6 Criminal Has Sentence Reversed
James Little, who entered the Capitol on Jan 6 but didn’t participate in either the violence or destruction of property, pleaded guilty to a charge which carried a sentence of up to six months in prison, probation, or a fine. The judge sentenced him to 60 days in prison and three years of probation. Little appealed, saying that he was wrongly sentenced to both prison time and probation. It should have been one or the other.
The DC Circuit Court of Appeals agreed, in a 2–1 decision, saying that he could not be sentenced to both prison time and probation for a single offense. He should have been sentenced to either prison time or probation, but not both. We’ll stop here for a moment and take a look at the judges who ruled on this case. The two judges who were in favor were Justin R. Walker, appointed by Trump, and Judith W. Rogers, who was appointed by Clinton. The dissenting judge was Robert L. Wilkins, who was appointed by Obama.
Not what I was expecting. I find the Clinton judge most interesting. Clinton had run in 1992 on diversifying the judiciary and promised to appoint more women and minorities. Which he did and Judge Rogers (appointed in 1994) was one of them. She is now 84 years old, so one would think that she would have been deeply offended by the actions of the insurrectionists who tried to stop the orderly transfer of power that had happened so many times during her long life. I would have guessed that she would have voted against
